Agreement to Terms

By opting in to receive SMS text messages and/or email communications from Eiduk Tax & Wealth ("we," "us," or "our"), you agree to these Terms and Conditions and our Communications Privacy Policy. If you do not agree to these terms, do not opt in to our messaging programs.

SMS Text Messaging Program

Program Description: When you opt in to our SMS program, you will receive recurring text messages from Eiduk Tax & Wealth. Messages may include appointment reminders, tax deadline notifications, service information, educational content, promotional offers, and responses to your inquiries.

Example message: "Hi [Name], this is a reminder of your upcoming appointment with John Eiduk, CPA, CFP® on [Date] at [Time]. Reply STOP to opt out."

Message Frequency: Message frequency varies. You may receive approximately 1-4 messages per month, though frequency may increase during tax season or when you have active matters with our firm.

Message and Data Rates: Message and data rates may apply. You are responsible for any charges from your mobile carrier. Check with your carrier if you have questions about your plan.

Opt-In: You must affirmatively opt in to receive SMS messages from us. You may opt in by submitting an online form on our website and checking the SMS consent box, providing your phone number during the scheduling process, or verbally during a conversation with our team. By providing your mobile phone number and agreeing to receive text messages, you consent to receive recurring automated marketing and informational text messages at the number provided. Consent is not a condition of purchasing any goods or services. If you do not wish to receive SMS messages, you can choose not to check the SMS consent box on our forms.

SMS Consent Sharing: The phone numbers and SMS consent obtained through our opt-in process will not be shared with third parties or affiliates for marketing purposes.

Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation message, and no further messages will be sent unless you re-subscribe. You may also opt out by contacting us at (847) 874-5299 or [email protected].

Supported Carriers: Our SMS program is supported by all major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

Email Communications Program

Program Description: When you opt in to our email program, you will receive email communications from Eiduk Tax & Wealth. Emails may include newsletters, tax planning insights, deadline reminders, service information, educational content, promotional offers, appointment confirmations, and responses to your inquiries.

Email Frequency: Email frequency varies based on your subscription preferences, relevant tax deadlines, and your engagement with our firm. You may receive approximately 2-4 emails per month.

Opt-In: You must affirmatively opt in to receive marketing emails from us. By providing your email address and agreeing to receive emails, you consent to receive recurring marketing and informational emails. Consent is not a condition of purchasing any goods or services.

Opt-Out: You may opt out of marketing emails at any time by clicking the "Unsubscribe" link at the bottom of any email or by contacting us at (847) 874-5299 or [email protected]. Please note that you may still receive transactional emails related to your account or services (such as appointment confirmations or document requests) even after unsubscribing from marketing emails.

General Terms

Eligibility: Our messaging programs are intended for residents of the United States who are 18 years of age or older. By opting in, you represent that you meet these requirements and that the phone number and/or email address you provide is your own.

No Sensitive Information: Do not send sensitive personal or financial information (such as Social Security numbers, bank account numbers, or tax documents) via SMS text message or unsecured email. These communications are not encrypted and should not be used for confidential information. Please use our secure client portal or contact our office directly for sensitive matters.

No Tax or Legal Advice: The information provided in our SMS and email communications is for general informational purposes only and does not constitute tax, legal, or financial advice. You should consult with a qualified professional regarding your specific situation. Do not rely on text messages or emails as a substitute for professional advice.

Accuracy of Information: You agree to provide accurate, current, and complete information when opting in to our messaging programs. You are responsible for updating your contact information if it changes.

Modifications: We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued participation in our messaging programs after any changes constitutes your acceptance of the revised terms.

Disclaimers

No Warranties: Our messaging services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that messages will be delivered, received, or received in a timely manner.

Limitation of Liability: To the fullest extent permitted by law, Eiduk Tax & Wealth shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in our messaging programs, including but not limited to damages for missed deadlines, delayed messages, or reliance on information provided in messages.

Carrier Liability: Mobile carriers and email service providers are not responsible for delayed or undelivered messages. We are not responsible for any issues arising from your carrier or email provider.

Privacy

Your privacy is important to us. Please review our Communications Privacy Policy for information about how we collect, use, and protect your personal information in connection with our messaging programs. We do not sell, rent, or share your phone number, email address, or SMS consent with third parties or affiliates for their marketing purposes.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Cook County, Illinois.
